No, you can't have the ring back! Recently I have had several husbands ask me if they can get the engagement/anniversary ring back in the divorce. Some of these rings have cost tens of thousands of dollars. The short answer is no. Case law provides that rings given in contemplation of marriage are a conditional gift, the condition being marriage. Once the marriage is performed the condition has been satisfied and the ring belongs to the wife. Now, if the marriage does not take place, the ring goes back to the husband-to-be.

Gifts during the marriage, not conditioned on any event, are absolute and once made cannot be revoked. So, the moral of the story is, if you spend a lot of money on a ring, just know you aren't getting it back if you get divorced later.
